Judicial Review on Amendments to the Licensed Land Surveyors Act, Malaysia: Court Grants Leave and Interim Stay
On 13 March 2025, the High Court of Malaya granted leave for the judicial review concerning the amendments to the Licensed Land Surveyors (Amendment) Act 2024 and the Licensed Land Surveyors (Amendment) Regulations 2024.
The High Court also issued an ad interim stay, which applies exclusively to the Institution of Geospatial and Remote Sensing Malaysia (IGRSM) and its members, pending the hearing of the main stay application. This means that the implementation of the amended provisions will be temporarily halted for IGRSM and its members until further court proceedings. However, IGRSM will argue that the stay should cover non-members as well during the hearing of the main stay application. The Institution remains committed to uphold the rights of not just its members but all those who have been affected by the amendments.
The next case management session is scheduled for 9 April 2025, where the court is expected to provide directions on the exchange of affidavits, the comprehensive stay application which involves all others, and the potential hearing date for the judicial review.
IGRSM will continue to pursue the matter in court and will seek an early hearing date due to the significant impact of the amendments. We remain committed to upholding the rights and interests of our members and those impacted, and will provide further updates as the case progresses.
